Toll Brothers Somersett, homeowner takes the low road

There is a Toll Brothers home that was built 3 years ago that is literally falling apart. There are doors that will not open, cracks throughout, and a leaky ceiling. There was a report done by Black Hawk Engineering that concluded the home was built on inadeqautely compacted soil. The owner has had to move out and the court has given Toll Bros. two deadlines to correct the problem but nothing has been done.

When I first heard this story my gut feeling was to be pissed at the big corporate developer taking  advantage of the small home owner just trying to live the American Dream. After taking a closer look I found that the home owner will not allow Toll access to the home to fix the problem because he wants Toll to buy the home back.

Channel 4 KRNV did a story on the issue a couple of days ago and even contacted Toll Brothers who had no comment. Once you get the attorneys involved Toll Brothers did the right thing by not commenting, let the attorneys do the talking for you. In these cases I have seen where it could cost as much as $500,000 to correct the compaction problem that this lot is having.

Also keep in mind that Toll Brothers bought completed lots from the developer and at the end of the day he will have to step up and take ultimate responsibility for this issue. I have not seen this happen anywhere else in Somersett and again when you develop 3500 lots or so you are bound to have problems with 2-3% of them. In my dealings with Toll I have seen where their back east corporate attitude has cost them some sales, in the past they tended to not be very flexible when it comes to putting deals together or trying to keep deals together. Im guessing in todays market that has probably changed somewhat.

Toll Brothers typically builds a good home and this could be an isolated issue, as I have not heard of anything else like this happening in Somersett. I do not agree with the McMansions that Toll has built on small lots in Somersett but overall the quality of home that they build for a production builder is very good.
