Listings Showing Active,But are under contract

This is happening to me more often these days. When I call to check availability on a home it is under contract but is still showing as an active listing in the local MLS. I ask them why they did not change it....One response was "I have a contract, but I am not really sure it is going to happen," Another response I got was " We have not changed it because we have not received the signatures from the bank" There should be some kind of indicator or selection other than "Active" on the MLS to show other brokers that it is "Almost Pending" so that we do not waste our time showing unavailable property.
Is this ethical to keep a house "Active" when you actually have a contract on a home or property? Is there a penalty for keeping a property Active when it is under contract?
To me it is more aggravating because I am wasting my time trying to get information on a home that is already Under Contract when I could be spending my time finding homes for my clients that are truly "Active"

Your MLS and local association should have rules set out about when they are supposed to have status changed -- check with them. Some MLS systems have a report a listing violation link on the site or again, contact your local board when you find listings out of compliance.
