The Problem with Foreclosures are the Banks
Posted Mar 28, 2008 @ 1:34 pm, Viewed by 305 Visitors, Read 328 Times.I am now absolutely convinced that the major issue with Tampa Foreclosures, Short Sales and the like are the Banks. This just happened to me this morning which caused a domino effect of other events that I will not go into in this Rant.
I have a listing that is a Villa in a really nice development. The owners are nice people and through no fault of their own, they needed to sell the property. This is not the property that they live in. Villas in this development are very tough to sell and we instructed them of the such at the time, in turn, they have given us many referrals for other business so it has been a good relationship so far. Last week we went by the property to check on it and noticed a FedEx document that was opened left at the door. We took it home and took a look at it and discovered that it was in fact a document from the bank regarding their loan. They had stopped paying on the loan. We in turn contacted our clients right away to let them know what was at the door and that we could in fact help them with this in the event of a short sale. We got little to no response back (they are pretty much embarrassed regarding the situation as many home owners are). We have a showing on the property this morning from an agent from another company and we get a call telling us that the clients are in fact interested in the property, but there is someone there drilling a hole in my Supra Key Lock box to gain entrance to the property. Mind you, my for sale sign is in the front of the home, my phone number is on it and I only live a short distance from the Property. On top of that, I have items in the home (staging) that I want back.
I call the bank, which has letters in its name of GM and C, and explain the situation to them that I am the Realtor that has the listing, I would like to be compensated for the destruction of my lock box and I would like my items back. The so called nice woman on the phone starts to yell at me and says that it is up to the home owner to get back to you and hangs up on me.
So I call back, get a different person this time,explain that I just want my stuff back and compensated for my lock Box, he tells me that no one will speak with me because I am not authorized to talk about the loan. I instruct him that I don't want to talk about the loan, just "My Stuff". This guy tells me the same as the prior agent at the bank, I ask nicely to speak with a Manager and he refuses, says that he will not allow this call to go any further. The Locks to the house have been changed and he then tells me that if the Client calls and asks for the keys, they will send them a copy. That in itself makes no sense as why change the locks in the first place if you are going to hand the keys out again. But this guy explains that it makes perfect sense to him. I then tell him this is a major issue as he will not allow me to speak with the manager, and he tells me his company is hugely successful in this industry....I almost laughed as he hung up on me as well.
We'll, that is pretty great, the Bank breaks my stuff, steals my stuff, and will not talk to me about my stuff because I am not authorized on the account. Although I am trying whole heartedly to assist my clients, their bank is not interested in doing anything with the property, other than taking it and everything in it hostage.
The moral of this story (which I could go on and on about) is if you are dealing with a short sale or a bank regarding a property, make sure you have all your ducks in a row, have all the proper documentation to the bank, have the name of the individual assigned to the loan, and a CROWBAR to get your stuff back when they change the locks!

Wow, that's crazy. I had an issue where they opened my lockbox to get the keys out to change the locks. At least they left my lockbox there. I still didn't think it was right. I think you have some legal recourse here, no?
That is pretty crazy, what is even more crazy was the way I was treated by the bank. I can assure you that I will steer clear of using that bank, recommending that bank to others because if this is how they treat customers, and agents who are basically their only saving grace is this fantastic mess that they created, then I want nothing to do with them. Legal recourse yes, going thru the process, probably not worth it. The value of my items are not that great, it was the principle of the thing that got me!
I hear you. The banks are truly amazing but you have to figure that the people you reached on the phone were at the bottom of the totem pole & had no authority anyway.
Yeah well, these people outright refused to let me at least speak with a manager. I have never been refused the ability to speak with someone higher up the pole. What does that tell you
I'm looking forward to the day when I can tell the new agents in my office "You think this market is tough? You should have been here in the Short Sale frenzy of '08" I've had dealings with several banks lately, some very positive and some along the lines of your blog post. I've found once you are assigned a negotiator things move along much more smoothly.

I am going to comment about my own blog here...I wrote this quickly and in absolute fury, which is why some of it does not make sense but have gone back to adjust some of the typos...I've calmed down some since then!
