Hmmm. In this case, I'd always recommend that you take screenshots... just in case. You never know if you'll need them.

Contact the agent. In most cases they don't know they are doing something wrong and are often willing to take it down once you tell them they are.

    John,

I sent you a PM. I've dealt quite a bit with this recently and you really need to bring the hammer down on these lazy a$$holes who think anything on the web is free for the taking. Naievety is no excuse, especially if the theft is from someone local / another local agent who doesn't have the creativity, work-ethic or brain power to succeed on their own.

Pardon my french but this type of stuff makes my blood boil. Take a look at my PM and good luck. Let us know how things turn out.

You can also contact the host. A reputable host will usually shut them down immediately.

I am dealing with content theft as I write this. In my case it appears the webmaster of the site was the culprit and the real estate agent hadn't a clue. The webmaster went as far as to say REW (and specifically Nick) gave him permission. As soon as the webmaster said that I knew I was dealing with a liar, as I know REW is about as far from content theft one can get.

This was my approach. I simply told the webmaster of the site that stole my content that my issue was not with him, but with the real estate agent of the site. Regardless of the agent's cooperation in this, the agent is ultimately responsible. Anyway, I spoke with the agent (a nice man, I might add), and kindly informed him I would call the police and file criminal charges as copyright infringement is a criminal offence. Needless to say, the real estate agent's webmaster is removing the content as we speak.

I do not think screen shots are necessary (I may be mistaken), as the WayBackMachine has a record of who had the content first.

On a side note, I was incredulous when the webmaster of the site suggested my concerns were racially motivated. What a slime bag!

As was I when the Webmaster suggested I gave him permission... When in actuality, I have never spoken to him.
