Seller Refused To Pay For Pest Control, Backs Out

My father recently decided he wanted to buy a house. There was a sales contract made both parties agreed and signed. When the house was inspected it was noted that it was in need of termite control. The seller agreed to take care of the problem. When the inspectors came in they noticed that the sewer line needed work. They estimated it needed 6,000 dollars worth of work. When the seller was notified of this he agreed to credit my father 5,000 dollars but refused to pay for the termite control. Now he wants to back out of the deal, it just went into escrow.

What rights is my father entitled to? Is the seller obligated to sale the house and take care of the problems? What should my father do in this situation.

Any amount of help would be appreciated.

Your father needs to talk to his attorney about this to find out what his rights are in his state. I had sellers that just didn't show up at the closing because they were upset about their purchase end and were mad at the mortgage company they were using. Everyone showed up at the closing except for the sellers.

The buyers had to run out & find another house & start over. I was told that they would have taken the seller to court if they hadn't found another house so quickly. And I'm not sure how it affected them since they also had a home that they had already sold.

My seller ended up re-listing his home with me when things calmed down & we did get it sold again and they closed on it and I think they bought the original home they had planned on purchasing. I think they were lucky that they didn't get into trouble with what they did but I'm not sure what the buyer's recourse really would have been.

It sounds like you need to know what dollar amount the seller agreed to contribute from the beginning, and realize any amount over and above that amount is up for renegotiation by both parties.
