How long have you been in contract? Where is your real estate agent? Parts of the puzzle seem to be missing.

Sorry ok my mortgage agent is in Texas as far my real estate agent the contract for the home was excueted friday. Now she called him and he told her no worries that we will get the loan yet when we finally did get him to return our call he told us he needed us to sign a autorization form so he could get one last thing done before he could turn our loan papers in to the undersigner. We haven't signed any papers saying we are bonded to do business with him. So my question is if we want to can we just back out with him and go with someone our realtor knows?

You had me concerned that you were a couple of weeks into the transaction. In CA, it's not uncommon for a buyer to switch lenders while in escrow.

In short, yes. I have seen buyers switch lenders up to 4 days before closing. If you are not happy with the level of service you are receiving you should switch now.
