    With agents out in the field and working out of their homes, I'm interested in how anyone can figure out just how many hours an agent actually "works" to fulfill this requirement. I work overtime in the good months and take it easier (tweaking my sites, planning for the coming "good months," etc.) during the slow winter months. I actually need to de-stress over the winter.

    I also work on vacations with my phone and laptop (and my partner agents to take over my buyers during my absence) and I took 5 trips in my record year (2007).
    Money Magazine says that Orland Park real estate is one of the best places to live in the U.S. Check out Homer Glen homes if you're interested in living in the newest Chicago suburb. Next door, Lemont homes are the priciest in the southwest suburbs and have held their value, even appreciating while prices in other areas have gone down.

    @JudyO,

    Easy, as its the Broker job to supervise, I should be able to tell if you are working 35 hours a week. At least approximately, but if you work a full time job or you are on vacation 12 weeks out of the year, you're not full time.

    I believe any broker who is worth their salt, can easily tell the difference between a Full Time and Part Time agent.

    I'd actually love it if there was a similar ruling here in IL. We'd certainly clean up the roster! But since there isn't a rule it made me chuckle because my prior broker would hire anyone that was breathing in the hopes of a deal or two.

    My current broker has more than 150 very experienced agents (we're not a training office and not the best fit for new agents) and even though he has a manager in our 2nd office, I know there's no way he keeps those kinds of tabs on the agents.

    Since there is no requirement to do so here, there's really no reason for him to have to get that kind of information. Although we offer splits, I believe most of our agents are on our 100% program, paying a monthly fee plus transaction fees. So it is in his best interest to get as many monthly fees and as long as the agents can pay that, he hopes we all produce for the transaction fees, but there are no requirements.

    My question is, does NY not have any agents that only sell a home or two a year because of this rule? What happens to them, are they forced to give up their license? I've tried re-reading the paragraph you posted (§175.21 Supervision of salesperson by broker) but can't quite figure it out.

    How can they mandate a 50 week work year for real estate agents? Even government employees often get over 4 weeks of vacation time per year, plus a dozen holidays or so.

    But, you say they don't enforce it.

    Nope it's not enforced, though I like the 35 hr part, I think the 50 week part is illegal. I do not know of another license that requires this. Just one of the many things we are or will be taking on be being involved.

    How about this one. You can only work in the county your office is located. Some of out counties are so small, if you blink, you have driven through them. Interesting concept since licensing is issues on a state wide basis.

    We are fighting that one too.

    Unless you are a corp, I think you are supposed to register your dba in every county you work. (We don't have an office requirement that I am aware of.)

    As for blinking and missing the county line... we can be driving 80mph and blink, but wake up an hour later and still be in the same county.

    Randy, Same here in NY. DBA's are county wide, though most do not know that, but in this business, anyone who is not an LLC or Inc is taking a huge risk with all of their personal assets.
