    Default clear title

    Has anyone ever advised a client NOT to allow the settlement/closing agent (title company or attorney) to conduct the title search, etc. activities and present the clear title and title insurance . . .

    Why would someone do that? Unless I'm misunderstanding what you're asking, it seems that you'd be opening yourself up to a heap of liability by doing so.

    Client doesn't want to pay the money associated with the closing costs that covers title search/insurance/etc. Doesn't care about the ramifications, no matter what/how I advise . . .

    Just wondering . . . would a client go through the process of trying to purchase a home . . . all the while . . . coming up with ways to kill the deal?

    If he is pushing hard against it get it in writing!! have him sign something that says you told him to do so and against your advice he is moving forward on his own. Get your broker and a lawyer to draft it - lest you get sued in 10 years out of the blue!

    Why doesn't he ask the seller to pay for it in his offer? Did you explain could happen and how he could be setting himself up for a big headache later?
