This must be a very common matter and I have never heard of it creating a problem for anyone. But there is always a first time and who knows what some local MLS might do. I know mine has had some interesting ideas in the past.
This may be just one more reason to promote yourself and not the company in the first place.

on a more serious note you will probably win your case but like you said, the time and cost is what you don't want to deal with. If you do consult an attorney find out if there is a "prevailing party" clause in your MLS/Association rules. Basically that means that if they drag you through a legal battle and you win, the loser has to pay the winners legal fees.
