Thread: Realtor did not represent me he represented the sell

    Default Realtor did not represent me he represented the sell

    I closed on 5 homes in may and the Realtor that I hired to do the work did not inform me he was representing the seller and not me the purchaser.
    Do I have a case. This was done in Florida.

    Perhaps. I am not familiar with Florida laws regarding "agency" but in Utah we have to disclose in writing who we are working for, buyer or seller.

    I'm not sure about Florida agency, either. Was the agent the listing agent for all 5 homes you purchased?
    Money Magazine says that Orland Park real estate is one of the best places to live in the U.S. Check out Homer Glen homes if you're interested in living in the newest Chicago suburb. Next door, Lemont homes are the priciest in the southwest suburbs and have held their value, even appreciating while prices in other areas have gone down.

    I live in Florida and our last purchase the realtor represented both parties and listed our old home (it's a long story and was a healthy commission for him). It has been a few years but I think we had to sign something to the fact that we were aware of the relationship.

    I don't know though if it was something in house or if it was required by the state.

    None of what you've said makes any sense to me at all. Five closings, you employed a Realtor that did not work for you, and you were the buyer?

    In florida it is presumed if not stated that the agency relationship would be as a transaction brokerage which means that they can in fact represent both the buyer and seller. Otherwise you must have signed a transitition to transaction notice. I'm sure they would have had you sign this right away.

    there's nothing wrong with representing two parties but he really should've notified you.
    Bad Credit history not such a problem with mortgages:
    mortgages for people with bad credit, bad credit mortgage and IVA mortgage

    I'm also wondering what you think you have a case for? If he did not disclose agency, that is one thing. If he didn't disclose agency and that materially affected you and you can show the damage, you might have something there. What brought this up?

    Of course, none of us here I believe are attorneys so the best advice is to seek legal counsel but we'd be happy to share more thoughts if we knew more about your position.
