James,
I am a little bit surprised by this question as I think you know the answer - copyright is copyright, and you do not have the right to reproduce someone else's work (Or create a derivative work) under any circumstances.

I am glad to see there is no answer to this question yet, as the question itself wreaks of lacking ethics.

"Taking a photo and photo shopping out other company information" cmon man.

The only way to get what I think you want, is to buck up and pay for your "own" artist to do your "own" rendering. Anything less would be stealing what someone else has paid to create.

Morgan is correct and if it came down to a legal battle, you'd probably loose although I'm no copyright lawyer.

There are some interesting situations that crop up in our business - what if I'm out taking a picture of an art fair for my blog and someone's photo gallery or painting happens to be in the picture? Technically this would be a problem for me. What about taking a picture of a community or house and a builder's sign is in the background with their trademarked logo? What about folks complaining that you have a picture of their home in a picture you took of a street scene? How much right does a homeowner have to request you dis-include their property in a photo?

I don't have the answers - I think they would be interesting court cases, but not ones I'd love to be a party of. Just another example of how litiguous our society has become - if I could buy E&O insurance for life, I might.

The only way around the copywrite is to wait 70 year after the creator dies for the copywrite to expire. Other than that there is not any moral or legal method to circumvent a copywrite.

As for items in the backgrounds of photos, it depends on the end use of the photo. For personel photos, you can take a picture of anything you see from a public location. The only limits are cameria specially designed to take convert images (Example: up-skirt camerias)

On photos used in advertising or for direct selling. If the item is not the focus of the picture or easily reconized, then you are generally OK. However, if someone were to ask for a home or image to be removed, I would do so. It is easier to send 15 minutes in photoshop bluring the area than 6 months in court.

last, if you have any improtant questions, talk with a copywrite lawyer - don't depend on a forum post.

Did you know that even drawing a picture or Mickey Mouse or just the circle for the head and two more for ears can be considerd an infringement? Copyright is strong stuff.

BTW, it is copyright, as in the right to your copy, not copywrite, which is the copy that you write.

I'm not an attorney, but I did stay in a Holiday Inn Express last night...

You've posted about copyrighted material so often it's getting ridiculous now.

Either pay for what you want to use, or create you own.

Stop trying to steal/weasel a way around using the intelligent property of others!

As a photographer, I run into copyright issues often. If you want to use something, call the person with the copyright and get written permission. Of course, this is going to cost you something.
