I am trying to figure out the rule/law with people signing into the IDX and putting their phone number down - does that eliminate the need for us to see if they are on the DNC list? I would assume it is ok since they put their number down and if they are putting a real number then they must assume chances are someone is going to call.

IDX registration is NOT double opt in (they don't have to verify) thus I would always check the DNC list because what if it was a competitor filling out your forms FROM the DNC just to get you in trouble from calling?

Ok then I will request a quick work order to add some verbiage something about the fact we do not sell your information and your are consenting for myself and my authorized representatives to contact you if need be even if your name is on the do not call list.

I put in the privacy policy and terms of use page on my website that by registering on the website and providing their email address and phone number (both required on my site) they are establishing a business relationship with me, and that by doing so, they are also giving me permission to email and/or call them for the purpose of supporting their real estate needs, until and unless they unsubscribe, at which point I delete them from my leads database so I no longer have the information to be able to call them, or the temptation to do so, which would be a violation of the DNC Act. A link to the privacy policy and terms of use page is placed prominently on the registration form page, and they are encouraged to read it before registering.
