I have a client ..... In 1996 Client purchased Parcel A (5 acres in Pinal County AZ). In 1998 Client purchased an addjacent Parcel B (1.5 acre). Both Deeds were recorded with legal descriptions but nont Parcel numbers
In 2005 Client became aware that his 1.5 acre parcel had been sold for back taxes and a Treasurer's Deed issued. Although living next to this parcel he never received any communication from the county regarding tax liens or tax sale. Client has all of his tax bills, cancelled checks and statements from the county demonstrating that he paid every tax bill he was ever issued on time. The Tax Statements have a legal description on them. From 96-98 the legal description on the tax statements references the legal description for Parcel A. From 98-2003 the Tax Statement Legal Description references both the legal for parcel A and the legal for Parcel B The client believes he was paying taxes on 6.5 acres (parcel a=5 parcel b=1.5 acres) We can not get from the Assessor's office a statement to the effect of how much acreage the Tax bill was based upon. I have hooked my client up with a Real Estate Attorney to get to the bottom of this but if anyone has first hand experience or insight into a case where the Treasurer issued a Treasurer's Deed and subsequently rescinded it I'd like to here from you. NOTE: This post was edited because it incorreclty identified a problme with legal descriptions, as it turns out the legal descriptions are accurate. The first response to this post addresses those issues which are not in contention. So if anyone had any expereince in overturning or rescinding a Treasurer's Deed pleasae let me know. Thanks

I can't speak to the rest, but what you'd be looking for from the title company is whether or not your client purchased an Owner's Policy of Title Insurance. If yes, then title defects are typically covered.
