I have a house that was built in 2004. We moved in in April of that year. After about 3-4 months in the house, we found a major water leak, from both front windows, library and living room. The builder had to take the entire front of the house off, stone, plywood, insulation and drywall. Heres the question, it is leaking again, and the home warranty company is denying the claim, stating that this is not structural. Can I go back to the builder, since the same problem happened during the first year, and obviously, it is not fixed?

I'd go to the builder. The home warranty company probably won't help much. They sell insurance and their job is NOT to pay you when you need something. After going to the builder, you'll probably have to get an attorney.

If you speak to the builder, don't get the answer you are wanting - and don't want to immediately jump to the attorney route, you could try to gain some leverage on the builder by going to the local HomeBuilder's Association and see if they can "encourage" him to back the quality of his work.

Definitely go to the builder. If they are honest and care about their reputation they will do the right thing and fix the problem.

yep, go to the builder, they didn't do their job the first time round.
