Default Referral Fees - is this ethical?

My client wants to find a builder who can build on the land she has inherited from her parents. However, most builders in this area do not "work" with Realtors - regarding paying the Realtor's commission. Am I allowed to charge a REFERRAL FEE for matching a client with a builder?

Best advice you will get on this I think will be for you to sit down with your broker and talk about it. Your broker should have some very good advice on how to approach this.

isnt this the second topic on this. I sure if if you look you will find a builder. It isnt that hard. Call the local assocation of builders. They will know some one.

What area are you in that Builders don't work with brokers? I find that pretty unusual! Most agents in the country are allowed to be paid referral fees through their Broker, so ask him about that!

Well maybe I am just "reading too much" into . . . the subtleties of conversation . . . but it just seemed like . . . well when I first brought this up with my broker . . . the . . . response . . . was . . . well you have to be careful about that . . . but you can do it. . . as long as you find a broker willing to . . . do it . . . they might have to adjust their price of the home to accomodate your referral fee . . .

I think RESPA only allows for broker to broker referral fees. Some states have exceptions allowing brokers to pay unlicensed people referral fees but there are limitations. That is opposite of what you want to do.

What's best for the individual?

Of course another thing to keep in mind is, this person is looking for a referral. So if you don't have any experience with the local builders and just hand them off to the first person you come in contact with swinging a hammer, it may not be too good for your rep if things don't go well.

I would suggest you not focus so much time on this one lead that probably won't pan out with the builder situation in you area. Focus your time instead on doing a good informative mailing in your farm area to get a good listing. Good Luck

Most builders I know are happy to work with Realtors. A 3% commission is common on custom work and it's factored into the price of the home. Most builders have some amount of "slush" in their bid to cover things like that. If not, they're probably not going to be around long.
