Question What to put in my Independent Contractor Agreement?

Well, today I got a big shock when I received a letter in the mail. It seems that my Broker decided he didn't want to hold anyones licenses any more and he sent them back to the Real Estate Commission ... 2 days ago!

What a shock that was. Fortunately, I always have a good "Plan B" so I'm working on signing up with a 100% brokerage that I had already been investigating.

My question is: What kind of special clauses should I write into my agreement that aren't typically found in the Broker/Agent Independent Contractor Agreement? All the financial aspects have been agreed upon but the general wording of the contract heavily favors the broker and his interests (as it should). However, I want to make sure I'm getting a somewhat-fair deal.

All I have so far is...
1) All the Listings/Buyers under representation I have are MINE. If I leave the brokerage at any time, broker will release them to me at no cost. (learned that from KW)

2) Broker must provide a 2-week written notice prior to terminating the independent contractor agreement. (learned that one 2 days ago)

3) Free to create and use my own Marketing materials, Business Cards and Web Domains in the promotion of myself.

4) ??? Need REW help !!!

Good idea, I wish I'd put that clause in mine about all my listings being mine but I was a newbie. Mine keeps them if I leave which stinks. What company are you guys going to if you don't mind me asking? Good luck!

You want it spelled out exactly how your escrows (if any) are paid out, length of the contract, and if there are any charges for leaving. For example, I know at least one brokerage here that signs you to a 12 month/12 deal contract and if you try and leave prior to the 12 months, they charge you the transaction fees if you did not do the 12 deals.

At $695 per transaction fee, if you had done only 2 deals before you decided you wanted to leave, you would owe $6950 before they would release your license.
