And now we are just waiting on him to tell us if we have been approved is it normal for a agent to not return call we are at the point we just want to fire him but we feel like we are so far into dealings with him he just keeps telling us he is waiting one one more thing to come back on our credit report is it possible to fire him and get a new agent since we havent signed any contracts with him yet??????

How long have you been in contract? Where is your real estate agent? Parts of the puzzle seem to be missing.

Sorry ok my mortgage agent is in Texas as far my real estate agent the contract for the home was excueted friday. Now she called him and he told her no worries that we will get the loan yet when we finally did get him to return our call he told us he needed us to sign a autorization form so he could get one last thing done before he could turn our loan papers in to the undersigner. We haven't signed any papers saying we are bonded to do business with him. So my question is if we want to can we just back out with him and go with someone our realtor knows?

In short, yes. I have seen buyers switch lenders up to 4 days before closing. If you are not happy with the level of service you are receiving you should switch now.
