Hi all,

Kyle brought up the do not call list in This Thread, and it reminded me of a discussion I got into with my wife (an agent).

She pointed out the article in the national "Realtor" magazine that comes out, so I checked the FTC's Q&A for Telemarketers which confirmed my suspicions... The FTC only has jurisdiction in inter-state calls. A call to someone in your own state is not covered by the do-not-call registry.

From the FAQ:

The do not call provisions of the TSR cover any plan, program or campaign to sell goods or services through interstate phone calls.
Caveats: Some states have seperate DNC laws you must check into. Also, I haven't read the ACTUAL law, just the "guidelines" and "FAQs"... But they were posted to the FTC website, not to "JoesLegalAdvice.com".

So, my interpretation would be that it would not "illegal" to call anyone in your own state. I wouldn't push it and argue with someone that got upset on the phone (had this happen), but I wouldn't stop calling my in-state list just because of the DNC registry.

Thoughts?

However, enforcement of Intrastate calls are regulated by the FCC.


"On June 26, 2003, the FCC revised its rules implementing the TCPA and established, in coordination with the Federal Trade Commission (FTC), a national Do-Not-Call registry. The registry is nationwide in scope, includes all telemarketers (with the exception of certain non-profit organizations), and covers both interstate and intrastate telemarketing calls (the rules start at 47 C.F.R. §64.1200). Consumers can place their telephone numbers on the registry through one telephone call or one Web click."
