Default incorporating - is it worth it for an agent?

Hello, I was talking with someone the other day on tour about tax stuff and he mentioned he was incorporated..is there much benefit as just an agent to being Incorporated? I know I can write of some stuff now I just cant see being able to do much more unless I owned the company or made a big 6 figure income. Thanks, John.

if you are under a broker, you might have to check with them and their attorney to see if they will allow you to incoporate under their agency.

thats just like an employee at burger king wanting to incorporate so they can get better benefits in my opinion.

Well I am not an "Employee" I am an independant contractor under my broker. It is a bit different then working for BK.

Yes, I am the same, I dont "work" for the broker I am an independent, but I also work under his broker license??, I dont know

i guess i used a bad example, but what i mean is you are working for them in a sense. You can be independent, but before you go outside the box, it is my understanding that you have to run things by your broker attorneys.

even if you license a company under your broker, your company just becomes the licensee of the broker and not you. it just seems like it would be the same.

are you paying a percentage of your commissions to your broker on a sliding scale or are you paying a flat fee?

for me its a set split for commissions, i small amount comes out for e+o ins. other than that theres nothing, no desk or office fees, they pay all advertising, and do some bulk mailings for me, other than that its me, i am not looking to start my own real estate company but this guy said he inc,ed himself and does well by taxes and such, i wont see him till next week to find out more..

It will vary state to state what you can and cannot do with relation to your real estate license and incorporating. There can be some substantial tax savings by incorporating, but you need to make sure you are doing enough volume to justify the cost of establishing and maintaining you corporation,LLC, or PA.

I think you need to be doing a pretty good level of business before incorporating makes sense but once you are say at $100,000 level of commissions you should definitely incorporate. You can pay yourself a salary and avoid a lot of self employment taxes. It also make the line much clearer for business expenses vs. personal expenses.

Many ways to go on this, liability and taxes are big issues and no 2 of us are alike.

I would suggest you spend a couple of bucks and see a tax advisor rather then an attorney, take everything you have and ask them what your best options are.
