yall are nuts with these "referral fees"
a.) it's a RESPA violation, so why would you make it so clearly documented as to post it on the internet? b.) it's stupid, because there should already be a symbiotic relationship between you and anyone who you do or would refer business to. that's how my boss, Joel is on pace to produce $26Million this year without purchasing a single lead, and he's had his license since december 05 I mean, it's not an accident - and I'm not trying to flame, just to pass on some knowledge - "leads" are hit or miss - but referrals should close 90-95% of the time. IE - I work with a BK attorney, with other web designers, with AE's at correspondent lenders, with REALTORS®, and contractors to provide a symbiosis. I get their customers to settlement, and that gets me paid, and it gets them paid. sometimes, they can't get paid on it - so i take em out for drinks - but referral fees? PSSSH! crazy. |

Real estate agents referring to other real estate agents is not a RESPA violation. The problems come from vendors (title companies, lenders, home inspectors, etc.) paying for referrals. That payment doesn't have to be just cash. It can be in any form, tickets to events, paying for agent's advertising, "leasing" space in the broker's office, throwing parties for only the agents who are giving vendors business. There's no dollar value minimum on this either. Some vendors say they can give up to $25 in value but you won't find that in the regs.
HUD has increased the number of their field inspectors and they're targeting real estate brokers and agents now not just vendors. Dr. Gary Lacefield is an expert on RESPA, and you can read a whole slew of RESPA cases he's reviewed on our website. Knowledge is more than power...it's protection.
