Default Team Splits?

What would be acceptable for an agent that has been offered from another agent that has overflowing buisness that keeps falling through the cracks to offer other agents leads from their website . Remind you they give you an area but see the request forms first, then forward them to you. (After they've seen price range,etc.) Would you even bother with this? Everyone wants to make money, I would never take advantage of anyone and do not want to be taken advantage of! It's suppose to be considered a "TEAM"? I don't get it. Please help!

I believe the standard referral fee is 25% and from everyone I have spoken to its across the board, Agents am I correct?

The inner-company standard between other agets is 25% where I am at, but I know servaral people that go to outside companies/agents in relocations because people pay 30% in other areas. I would be happy to pay 25% to anyone referred to me for the San Diego (RESPA requires that they are a licensed RE Agent)

(Our team is a team of 2 and we split everything 50-50.)

We, of course, get the pick of the litter. We give away picked over leads at 15-20% to our friends ... If these are leads that haven't in any way been qualified yet ...

If they are quality leads, that have in some way been qualified, then 25% or even 30% to hungry agents.

And I don't think it is taking advantage of anyone. If they think it is taking advantage, then they can get their lead somewhere else or negotiate for it.

But,... we reciprocate. If we give you a lead for 15%; if you ever have the chance to give us a lead, we expect it at 15% as well.

That's the way we do it.

First of all no one on this forum should be talking about commission % splits with real numbers. I believe that could be taken as "anti trust" violation.

With that said, it looks to me as though newinrealestate is concerned that s/he is not getting the fair side of the team's deal.

It occurs to me that newinrealestate may very well be new indeed. Is this true. IF so, why do you feel that you should share equally in the leads. Did you create, position and pay for the website that is generating the leads? Do you have the know how and experience to turn the leads? If all things are equal then you may be within your rights to expect more.

If not, you need to pay your dues. Sorry, that's how I feel.

The more transactions you work, the better you will be. Eventually you will be able to handle any situation that comes your way. Experience is the best teacher, so enjoy the leads, work hard and your business will grow naturally.

Be thankful you are in a position to accept leads without having to go wear your shoe leather out knocking on cold doors....or cold calling.

Whats acceptable is to be thankful that the agent thought enough of you to give the leads. Last I heard the turn over rate for Realtors is pretty high.. LOL I would of been happy when I started almost 5 years ago to have leads handed to me..the key to real estate to sales after the sale.. so yeah let say you get 50% you should be more concerned about the closing the deal, following up and hopefully earning a referral. One happy client might have 10 friends that need a house..

I was under the impression that a commision split (or referral fee) had nothing to do with "anti-trust" violations because it is an internal split that is set by the broker to the agent and since the brokers commision itself from the sale is neogiatiable with the client there wouldn't be a problem.
Am I off in my understanding (given there are different laws in different states - this would be federal law)?

San Diego,

IMHO, you are correct, discussing within the office, with agents and setting standard rate is perfectly fine.

I believe, Krystal is also right, my understanding is after reading her post, she may be thinking and referring to, questions such as what is a "going rate" "average rate" are things that can violate Sherman Anti-trust law.

However, this thread started out with the tone of internal affair, and in my opinion it does not violate Sherman Anti-trust. Offcourse now it is all over the place.

please keep in mind, my comments are not made as an agent, I am not an agent or associated with the real estate profession any further then producing their sites and educating them about the internet. I'm the first one who shot out a # as I thought it was a standard across the board but newinrealestate and anyone else not familiar with with real estate that may be reading these comments please keep in mind that I am the least authority on real estate at this board and only to be listened to when it comes to websites lol

After rereading my post, I hope it wasn't taken as pointing fingers and making people wrong or right, as that was not my intention. I was just looking for clarification of her opinion for my own personal understanding. (but thank you commenting Arizona Home, I believe you are correct on both points)

AND as an agent - I have learned and learned: "I am licensed to sell real estate, not to give legal advice - go get a lawyer for that one" So just a CYA like Seo Guy, Don't take my word for it... LOL
