Yes, you are ok to make phone calls to anyone who has “registered on your website”
The TCPA rules are about 1-1 consent which your consumer gives you when registering on your website.
Where you run afoul of the rules is when you capture consumer’s information for one purpose (let’s say to discuss real estate) and then you refer or provide that information to a third party without expressed consent for you to do so,
In addition, the consumer should have a reasonable expectation of the subject matter of the relationship. So if your website is all about real estate and listings and you call them to sell them insurance for instance, that would not be reasonable.
In the next release (coming in a few weeks) we are providing a new “global forms message” tool that will allow you to create a message (including HTML / links if you wish) to update your TOS and also message any explicit consent information. )
For example you may write to clarify:
"By filling out this form, I authorize Real Estate Webmasters to contact me to discuss their services via any channel including but not limited to email, text, phone, and social media. I understand my information will not be shared with any third party and will be used explicitly to engage in discussion of REW services. "
